Electronic Delivery of Statements and Documents Agreement

Definitions

In this Agreement, the word “Statement” refers to your periodic Statement of Account. The word “Document” refers to any other disclosures or notices that we would normally provide to you in a written, paper copy form. The words “you” and “your” refer to you, the customer of WSFS Bank. The words “we,” “us,” and “our,” mean WSFS Bank.

Consent to Receive Periodic Statements and Documents Electronically

You agree to accept your Statements and Documents electronically (“Online Statements”) for the accounts you have selected, which may include checking, savings, or loan accounts. You further agree that we will discontinue mailing a paper statement to you for any such accounts and will communicate with you electronically, as necessary. You also agree to receive Documents electronically (“Online Documents”) when we elect to make them available in electronic format. Online Documents include, but are not limited to your periodic Notice of Billing Error Rights and your periodic Error Resolution Notice for Electronic Funds Transfers. You agree to be bound by any and all laws, rules, regulations and official issuances applicable to Online Statements and Online Documents now existing or which may hereafter be enacted, issued or enforced, as well as such other terms and conditions governing the use of other facilities, benefits, or services that we may periodically make available to you in connection with Online Statements and Online Documents.

If any account(s) that are eligible to receive Online Statements or Online Documents are owned jointly, any owner of that eligible account may enroll in or terminate enrollment in Online Statements or Online Documents. All joint account owners of any eligible account(s) will be bound by the enrollment or termination of enrollment by any other account owner.

Receiving Online Statements or Documents

If you enroll in Online Statements or Documents, we will send you an email notice to your email address when your statement or document becomes available for viewing online. You are responsible for all of the following:

  • Providing WSFS Bank with a working individual email address
  • Notifying WSFS Bank of your new working individual email address each time you change your email address by logging in to our website and updating your email address in your Profile
  • Utilizing one of the methods described below under “How to Contact Us.”

Any notification of change of email address you provide to us must be received by us at least seven (7) business days before scheduled delivery of the statements or Legal Disclosures. Include in your communication to us your name, address, account number and your new and old email addresses.

Please note that any change you make to your email address will only change your email address for purposes of electronic statements and Legal Disclosures. It may not change your email address for purposes of any other communications you might receive from us through our website or otherwise.

Requesting a Paper Copy of Statements or Documents

You may request a paper copy of your periodic Statement or Documents received electronically under this Agreement by contacting us at 888.973.7226. A fee may be assessed for a paper copy of your Statement or Document. Refer to our current Personal Deposit Services Cost Summary for details. To avoid this fee, consider printing your Statement or Document from your computer or saving it electronically.

Right to Withdraw Consent

If you agree to receive Online Statements and Online Documents, you may subsequently withdraw your consent at any time. After logging into WSFS Online Banking & Bill Pay, select “Customer Service” then “Change Document Delivery Method”. There are no fees* for withdrawing your consent for Online Statements and Online Documents and opting to return to paper Statements and Documents. If you withdraw your consent, you will no longer have access to Statements and Documents via WSFS Online Banking & Bill Pay. We will mail your Statements and Documents to the mailing address we have on file. Withdrawal of your consent to receive Online Statements and Online Documents will be effective only after we have a reasonable period of time to process your request.

*Important Note:

Although there are no fees to switch from electronic to paper delivery or from paper to electronic delivery of Statements, there may be differences in account-related charges based on whether you receive your Statements electronically. For example, there may be a discount on the monthly service charge on an account if you choose Online Statements. Please refer to the applicable account product disclosure(s) and Personal Deposit Services Cost Summary for details (if applicable) provided to you at the time of account opening and available online.

Availability of Service

You agree that we shall not be liable if you are unable to gain access to WSFS Online Banking from time to time. You understand that some or all of Online Statements or Online Documents and/or other online services may not be available at certain times due to maintenance and/or computer, communication, electrical or network failure, or any other causes beyond our control. In certain circumstances, we will notify you of prolonged outages when we are able to do so.

Security

You agree to protect the confidentiality of your user ID, password, and account number. You understand that if someone other than you has access to your password by itself, or uses your password together with other account information, this may allow unauthorized access to your account.

Procedures

You will receive an e-mail shortly after an Online Statement or Online Document is generated. The email notice will inform you that your Online Statement or Online Document is available in WSFS Online Banking & Bill Pay. You will need to log in to WSFS Online Banking & Bill Pay with your user ID and password and then select Online Documents to view your Online Statement or Online Document.

Change of Internet Service Provider, Email Address, or Computer Equipment

If you change your email address used to notify you of the availability of Online Statements and Online Documents, you agree to notify us of the new email address you will be using. If we change the hardware or software to communicate electronically with you and our change materially affects your ability to access or receive Online Statements or Online Documents, we will notify you of the changes by email and provide you with a statement of your right to withdraw consent.

Closed Accounts

For any closed accounts, Online Statements and Online Documents will no longer be available to you. If you need copies of your Statements or Documents after your accounts are closed, you will need to visit a WSFS Bank branch or call customer service at 888.973.7226. A fee may be assessed for a paper copy of your Statement or Document. Refer to our current Personal Deposit Services Cost Summary for details.

Disclaimer of Warranty and Limitation of Liability

We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with Online Statements and Online Documents provided to you under this Agreement. We do not and cannot warrant that the electronic delivery of Statements and Documents service will operate without error, or that the service will be available at all times. Except as specifically provided in this Agreement, or otherwise required by law, you agree that WSFS Bank’s officers, directors, employees, agents or contractors are not liable for any indirect, incidental, special, or consequential damages (i) under this Agreement; (ii) by reason of any services or products provided under this Agreement; or (iii) by reason of your use of the Electronic Delivery of Statements and Documents service, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theory.

Additional Terms and Conditions

This Agreement is in addition to the terms and conditions governing your account provided to you at account opening. This Agreement is also in addition to our Online Banking Agreement and Disclosure. To the extent that this Agreement is inconsistent with any of the terms and conditions, disclosures and agreements provided to you at account opening, the terms and conditions of this Agreement shall supersede all other terms and conditions with respect to Online Statements and Documents. You should review those agreements for any applicable fees, for limitations on the number of transactions you can make, and for other restrictions that might impact your use of an account with the Electronic Delivery of Statements and Documents service and Online Banking.
